| Türkçe Özet | Bu çalışma, usûl-furû ilişkisine yönelik çalışmalarıyla dikkat çeken Cessâs'ın uygulamalı fıkıh usûlü niteliğindeki `Şerhu Muhtasar-ı Tahâvî` adlı eserindeki fıkıh yöntemini detaylı ve kapsamlı bir şekilde incelemeyi konu edinmektedir. Bu bağlamda, Cessâs'ın Şerhu Muhtasar-ı Tahavi isimli eserindeki fıkhî meselelere yaklaşımı incelenerek hangi usûl/istidlal yöntemleri ve bu yöntemleri nasıl kullandığı tespit edilecektir. Özellikle fıkıh metinlerinde, konuların çeşitliliği ve karmaşıklığı nedeniyle yazarların bazen farklı meselelerde birbirine zıt açıklamalar yaptığı dikkate alınarak eserdeki usulî yaklaşımın kendi içinde ne derece tutarlı olduğu hususuna önem verilecektir. Ardından müellifin `el-Fusûl fi'l-Usûl` adlı eserindeki teorik anlatımıyla uyumu analiz edilecektir. Amacımız, Cessâs'ın usûl düşüncesinin bütüncül bir şekilde ele alınmasına katkıda bulunmak ve usûlün furûya yansımasını, mezhebin genel manzarasını sunan bir metin üzerinden inceleyerek usûl-furû ilişkisini somut bir örnek üzerinden ortaya koymayı hedeflemekteyiz. Araştırmanında metin analizi, karşılaştırmalı inceleme ve tutarlılık analizi teknikleri kullanılacaktır. |
| İlgilizce Özet | This study aims to examine in detail and comprehensively the fiqh methodology in Cessâs's work titled Sharh Mukhtasar al-Tahawi, which is an applied usul al-fiqh and notable for his studies on the usûl-furû relationship. In this context, by analyzing Cessâs's approach to legal issues in Sharh Mukhtasar al-Tahawi, we will identify which usûl (principles)/istidlal (reasoning) methods he uses and how he employs these methods. Given that authors sometimes provide contradictory explanations in different issues due to the diversity and complexity of topics in fiqh texts, special attention will be paid to the degree of consistency within the methodological approach of the work itself. Subsequently, the alignment with the theoretical exposition in the author's work al-Fusûl fi'l-Usûl will be analyzed. Our aim is to contribute to a holistic consideration of Cessâs's usûl thought and to reveal the usûl-furû relationship through a concrete example by examining how usûl reflects on furû via a text that presents the general view of the madhhab (school of thought). The research will employ techniques of text analysis, comparative examination, and consistency analysis. |
